By downloading, installing, or using Delay (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

THIS APP IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
Please Read Carefully:
- Not Created by Medical Professionals: This app was created by an individual with lived experience of OCD, not by a licensed physician, psychiatrist, psychologist, therapist, or other healthcare provider.
- Not a Substitute for Professional Care: This app is not a substitute for professional mental health treatment. If you have OCD or suspect you have OCD, please consult a qualified mental health professional.
- Not Therapy: Using this app does not create a therapist-patient relationship. The app provides tools for self-directed practice based on ERP (Exposure and Response Prevention) principles, but it is not therapy.
- No Medical Claims: We make no claims that this app will cure, treat, or improve OCD or any other condition. Results vary, and the app may not be helpful for everyone.

Description of Service
Delay is a mobile application that provides:
- Timed non-response practice sessions
- Tools based on ERP principles
- Practice tracking
- Educational information about OCD and ERP
The app is designed to supplement, not replace, professional OCD treatment.
Eligibility
You must be at least 13 years old to use this app. If you are under 18, you should have parental or guardian consent and supervision.
Subscriptions and Payments
Free Trial
New users receive a free trial when they choose a subscription plan. Trial length depends on the plan you select:
- Annual plan: 14-day free trial
- Monthly plan: 7-day free trial
- Weekly plan: 3-day free trial
You can use all features during the trial. No payment is required to start the trial.
Subscription
- After the trial, continued use requires a paid subscription
- Subscription pricing is displayed in the app
- Payment is processed through the Apple App Store or Google Play Store
- Subscriptions auto-renew unless cancelled
Cancellation
- You may cancel your subscription at any time
- To cancel: Go to your device’s Settings → [Apple ID / Google Account] → Subscriptions → Delay → Cancel
- Cancellation takes effect at the end of the current billing period
- We do not provide refunds for partial billing periods
Refunds
User Responsibilities
By using this app, you agree to:
- Use at Your Own Risk: You understand that this app is not medical treatment and use it at your own discretion and risk.
- Seek Professional Help: You will seek professional mental health care if needed and will not rely solely on this app for OCD treatment.
- Honest Self-Assessment: You will honestly assess whether this app is helpful for you and discontinue use if it is not.
- Not Misuse: You will not use the app in any way that could harm yourself or others.
- Compliance: You will comply with all applicable laws and regulations.
Intellectual Property
All content, features, and functionality of the app, including text, graphics, logos, and software, are owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We do not warrant that:
- The app will meet your specific needs or expectations
- The app will be uninterrupted, timely, secure, or error-free
- The results from using the app will be accurate or reliable
- Any errors will be corrected
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or goodwill
- Personal injury or emotional distress
- Any damages arising from your use or inability to use the app
- Any damages arising from reliance on the app
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the app
- Your violation of these Terms
- Your violation of any third-party rights
Changes to the App
We reserve the right to:
- Modify or discontinue the app at any time
- Change features, pricing, or availability
- Update these Terms
Continued use after changes constitutes acceptance of the new Terms.
Termination
We may terminate or suspend your access to the app at any time, without notice, for any reason, including violation of these Terms.
Governing Law
These Terms are governed by the laws of the State of Maine, United States, without regard to conflict of law principles.
Dispute Resolution
Any disputes arising from these Terms or the app shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class actions.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the app.
